Dialogue as Text Containing Emoticons: Jurislinguistic Approach

چکیده

The article considers dialogues containing emoticons, which have become case materials of various lawsuits. key problems for legal linguistics related to the functioning texts emoticons in modern electronic communication are considered: verbalization including online with help specialized emoji-translators, and their interpretation lexicography. Basing on considered court cases, problem similarity between text, includes verbalized does not contain pictograms, is also formulated. analysis pictogram texts, as well messages it has been concluded that text pictographic elements can be represented degree. Three options possible: 1) presence complete (identity) its exact verbalization; 2) partial without elements; 3) lack elements. degree arises from phenomena polysemy, homonymy synonymy. appearance new meanings emoticon leads development synonymy ultimately message texts. culture determined, associated broadening narrowing communicative context situation position addresser addressee message. Between there no may a dictum (identity), but at same time accompanied by mode differences. Thus, determined both ontologically, i.e. very use signs, characterized multifaceted relationships, epistemologically, depends social, psychological traits, characteristics attitudes persons entering into communication.
